DMCA
Protecting intellectual property is essential to maintaining a safe and fair online environment. This notice outlines how our platform complies with the Digital Millennium Copyright Act (DMCA) and the procedures available to copyright owners, users, and content providers in cases of alleged copyright infringement. We are committed to respecting the rights of creators while ensuring that users have clear remedies when mistakes occur.
When we receive a takedown request that meets all statutory requirements, the allegedly infringing material will be removed or access to it will be restricted. We also notify the uploader of the content and provide them with instructions on how to respond with a counter-notification if they believe the claim was made in error. This process is designed to be fair, balanced, and compliant with applicable laws.
Information Required in a Valid Takedown Notice
A takedown notice must include all of the following elements:
- Description of the copyrighted work claimed to be infringed, or a representative list of multiple works.
- Identification of the specific material alleged to be infringing, including URLs, file paths, or sufficient detail to locate the content on our platform.
- Your legal name, physical address, telephone number, and email address.
- A statement declaring your good faith belief that the use of the material is not authorized by the copyright owner, its agent, or applicable law.
- A statement under penalty of perjury that the information provided is accurate and that you are the copyright owner or authorized to act on their behalf.
- Your electronic or physical signature.
Incomplete or inaccurate notices may be rejected or delayed. Submitting precise links, identifiers, or supporting evidence will help ensure efficient processing of your request.
Filing a Counter-Notification
If your content has been removed due to a takedown request and you believe this was a mistake, you may file a counter-notification. A valid counter-notice must include the following details:
- Identification of the content that was removed and the location where it appeared before removal.
- Your full name, mailing address, telephone number, and email address.
- A statement, made under penalty of perjury, that you believe the removal of your content was due to an error or misidentification.
- A statement in which you consent to the jurisdiction of the appropriate Federal District Court, or if outside the United States, to any judicial district in which our platform is located.
- A declaration that you will accept service of process from the party that submitted the original notice or their authorized agent.
- Your electronic or physical signature.
Once we receive a valid counter-notice, it will be forwarded to the original complainant. If they do not file a court action within 10–14 business days, the content may be restored to our platform.
Consequences of Misuse
Submitting false, misleading, or fraudulent DMCA notices or counter-notifications is a violation of the law and may result in liability for damages, including costs and attorney fees, under Section 512(f) of the DMCA. Abuse of this process may also result in suspension or termination of your account on our platform.
Best Practices for Submitting Notices
To avoid delays, we recommend that you:
- Provide accurate URLs or direct links to the allegedly infringing content.
- Submit clear and detailed descriptions of your copyrighted work.
- Verify whether your use or the disputed use may fall under fair use, licensing, or statutory exceptions before filing.
- Keep copies of all correspondence and evidence submitted for your records.
Commitment to Compliance
Our platform will always handle DMCA claims neutrally and transparently. We do not mediate disputes but ensure that the legal rights of both copyright owners and content uploaders are respected. By submitting a notice or counter-notification, all parties agree to act in good faith and in accordance with applicable copyright law.
This DMCA process is intended to strike a balance between protecting intellectual property and maintaining freedom of expression for our community. All users are expected to follow these guidelines when addressing copyright matters.
